In accordance with article R211-14 of the French Tourism Code, travel brochures and contracts offered by travel agents to their customers must include the following general conditions in extenso, as set out in articles R211-5 to R211-13 of the French Tourism Code.

Order of March 1, 2018 setting the model information form for the sale of travel and stays.
These new provisions apply to all new travel contracts concluded from this date onwards, and concern "all natural or legal persons who, as part of their commercial, industrial, craft or liberal professions activity, draw up and sell or offer for sale: tourist packages, travel services relating to transport, accommodation, vehicle rental or other travel services that they do not produce themselves. They also apply to professionals who facilitate the purchase of related travel services by travelers."
Tourist package: the new Tourism Code
(art L.211-2 II) specifies that the notion of package applies to the combination of at least two different travel services for the purposes of the same stay or trip exceeding 24 hours or including an overnight stay. The combination of two tourist services alone never constitutes a package, unless they are combined with another travel service. The retailer and the organizer are fully responsible for the fulfillment and proper execution of all obligations arising from the signed contract. The term "package" refers to travel services put together by a single upstream professional and linked by a single contract.
The following may thus meet this definition:
- A set of services purchased from a single point of sale, the total of which is determined before the traveler agrees to pay.
- A set of services offered, sold or invoiced at an all-inclusive or total price
- Any service advertised or sold as a "package" or similar (package, combined, etc.).
- A selection of different types of travel services combined after the conclusion of a contract by which a professional authorizes the traveler to choose from this selection.
- A package of services purchased from separate professionals via linked online procedures.
Article R. 211-3
All offers and sales of the services mentioned in article L.211-1 must be accompanied by appropriate documents that comply with the rules set out in this section.
Article R. 211-3-1
The exchange of pre-contractual information or the provision of contractual terms and conditions shall be in writing. This may be done electronically. The name or company name and address of the organizer or retailer are mentioned, together with an indication of his registration in the register provided for in article L.141-3 or, where applicable, the name, address and indication of the registration of the federation or union mentioned in the second paragraph of article R.211-2.
Article R. 211-4
Prior to the conclusion of the contract, the organizer or retailer must provide the traveler with the following information:
1° The main characteristics of the travel services:
a) The destination(s), itinerary and periods of stay, with dates and, where accommodation is included, the number of overnight stays included;
b) The means, characteristics and categories of transport, the places, dates and times of departure and return, the duration and place of stopovers and connections. When the exact time has not yet been fixed, the organizer or retailer informs the traveler of the approximate time of departure and return; c) The location, main characteristics and, if applicable, the tourist category of the accommodation under the rules of the country of destination;
d) The meals provided;
e) The visits, excursions or other services included in the total price agreed for the contract;
f) Where this is not apparent from the context, whether any travel services will be provided to the traveller as part of a group and, if so, if possible, the approximate size of the group;
g) Where the benefit of other tourist services provided to the traveller relies on effective verbal communication, the language in which these services will be provided;
h) Information on whether the vacation trip or vacation stay is generally suitable for people with reduced mobility and, at the traveller's request, precise information on the suitability of the vacation trip or vacation stay for the traveller's needs;
2° The corporate name and geographical address of the organizer and retailer, as well as their telephone and, if applicable, electronic contact details;
3° The total price including taxes and, if applicable, all fees, charges or other additional costs, or, when these cannot be reasonably calculated before the conclusion of the contract, an indication of the type of additional costs that the traveller may still have to bear;
4° Terms of payment, including the amount or percentage of the price to be paid on account and the timetable for payment of the balance, or the financial guarantees to be paid or provided by the traveller;
5° The minimum number of people required for the trip or stay and the deadline mentioned in III of article L.211-14 preceding the start of the trip or stay for possible cancellation of the contract if this number is not reached;
6° General information on passport and visa requirements, including the approximate time it will take to obtain a visa, as well as information on health formalities in the country of destination;
7° A statement indicating that the traveler may cancel the contract at any time before the start of the trip or stay, subject to payment of appropriate cancellation fees or, where applicable, standard cancellation fees charged by the organizer or retailer, in accordance with I of article L.211-14 ;
8° Information on compulsory or optional insurance covering the cost of cancellation of the contract by the traveler or the cost of assistance, including repatriation, in the event of accident, illness or death. With regard to the packages defined in e of 2° of A of II of article L.211-2, the organizer or retailer and the professional to whom the data is transmitted ensure that each of them provides, before the traveler is bound by a contract, the information listed in this article insofar as this is relevant to the travel services they offer.
The form by which the information listed in this article is brought to the attention of the traveler is set by joint order of the Minister of Tourism and the Minister of Economy and Finance. This order specifies the minimum information to be brought to the traveler's attention when the contract is concluded by telephone.
Article R. 211-5
The information mentioned in 1°, 3°, 4°, 5° and 7° of article R.211-4 communicated to the traveler forms part of the contract and may only be modified under the conditions defined in article L.211-9.
Article R. 211-6
The contract must include, in addition to the information defined in article R.211-4, the following information:
1° The particular requirements of the traveler that the organizer or retailer has accepted;
2° A statement indicating that the organizer and the retailer are responsible for the proper execution of all travel services included in the contract, in accordance with article L.211-16, and that they are required to provide assistance to the traveler in the event of difficulties, in accordance with article L.211-17-1;
3° The name of the entity responsible for insolvency protection and its contact details, including its geographical address;
4° The name, address, telephone number, e-mail address and, where applicable, the fax number of the organizer's or retailer's local representative, a contact point or other service through which the traveler can quickly contact the organizer or retailer and communicate with him effectively, request assistance if the traveler is in difficulty or complain about any non-conformity noted during the execution of the trip or stay;
5° A statement indicating that the traveler is required to communicate any non-conformity that he observes during the trip or stay in accordance with II of article L.211-16 ;
6° Where minors, unaccompanied by a parent or other authorized person, are travelling on the basis of a contract including accommodation, information enabling direct contact to be established with the minor or the person responsible for the minor at the minor's place of stay;
7° Information on available internal complaint handling procedures and out-of-court dispute settlement mechanisms and, where applicable, on the entity to which the professional belongs and on the online dispute settlement platform provided for in Regulation (EU) No 524/2013 of the European Parliament and of the Council;
8° Information on the traveler's right to transfer the contract to another traveler in accordance with article L.211-11.
With regard to the packages defined in e of 2° of A of II of article L.211-2, the professional to whom the data is transmitted informs the organizer or retailer of the conclusion of the contract giving rise to the creation of a package. The professional provides him with the information he needs to fulfill his obligations as an organizer. As soon as the organizer or retailer is informed of the creation of a package, he provides the traveler, on a durable medium, with the information mentioned in 1° to 8°.
Article R. 211-7
In accordance with articles L.211-1 and R.211-7 of the French Tourism Code, the customer may assign his contract. You must notify us by any means that will allow us to obtain an acknowledgement of receipt no later than seven days before the start of the trip, indicating precisely the name of the assignee and the name of the replacement, and proving that the latter meets the same conditions as the former.
The assignor of the contract and the assignee are jointly and severally liable for payment of the balance of the price as well as any fees, charges or other additional costs incurred by this assignment. They are obliged to pay any resulting costs in advance.
Please note that the insurance contract is nominative and therefore non-transferable. Since airlines refuse name changes, the price of the assignee's ticket is likely to be higher than the original price. Furthermore, if the ticket is issued, it cannot be exchanged or reimbursed, and the travel contract cannot therefore be assigned.
Under no circumstances is this assignment subject to prior authorization by the organizer or retailer, subject to payment of the cancellation and modification fees as defined in the special conditions (§ 4 to 4.3).
Article R. 211-8
After conclusion of the contract, price increases are only possible if they are the consequence of a change in the price.
When the contract includes an express possibility of price revision, within the limits provided for in article L.211-12, it mentions the precise methods of calculation, both upwards and downwards, of the price increases.
price variations, in particular the amount of transport costs and related taxes, the currency or currencies that may have an impact on the price of the trip or stay, the portion of the price to which the variation applies, and the exchange rate of the currency or currencies used as a reference when establishing the price appearing in the contract.
Regardless of its size, a price increase is only possible if the organizer or retailer notifies the traveler of it in a clear and comprehensible manner, accompanied by justification and calculation, on a durable medium, no later than twenty days before the start of the trip or holiday.
In the event of a price reduction, the organizer or retailer has the right to deduct his actual administrative expenses from the refund due to the traveler. At the traveller's request, the organizer or retailer shall provide proof of these administrative expenses.
Article R. 211-9
When, before the traveler's departure, the organizer or retailer is obliged to make a change to one of the essential elements of the contract, if he cannot meet the particular requirements mentioned in 1° of article R.211-6, or in the event of a price increase of more than 8%, it shall inform the traveller as soon as possible, in a clear, comprehensible and visible manner, on a durable medium:
1° Of the proposed modifications and, if applicable, of their repercussions on the price of the trip or stay;
2° A reasonable period of time within which the traveler must inform the organizer or retailer of his decision;
3° The consequences of the traveller's failure to reply within the set time limit;
4° If applicable, the alternative service offered, as well as its price.
If the modifications to the contract or the alternative service lead to a reduction in the quality of the trip or stay or its cost, the traveler is entitled to an appropriate price reduction. If the contract is cancelled and the traveler does not accept an alternative service, the organizer or retailer will reimburse all payments made by or on behalf of the traveler as soon as possible, and in any event no later than fourteen days after the cancellation of the contract, without prejudice to compensation in application of article L.211-17.
Article R. 211-10
The organizer or retailer makes the refunds required under II and III of article L.211-14 or, under I of article L.211-14, reimburses all payments made by or on behalf of the traveller, less the appropriate cancellation costs. These reimbursements to the traveler are made as soon as possible, and in any event no later than fourteen days after the cancellation of the contract.
In the case provided for in III of article L.211-14, the additional compensation that the traveler is likely to receive is at least equal to the penalty that he would have incurred if the cancellation had been made by him on that date.
Article R. 211-11
The assistance owed by the organizer or retailer in application of article L.211-17-1 consists in particular of:
1° Providing useful information on health services, local authorities and consular assistance;
2° Helping the traveler to make long-distance communications and find other travel services. The organizer or retailer is entitled to charge a reasonable price for this assistance if the difficulty is caused intentionally by the traveler or by his negligence. The price charged shall in no case exceed the actual costs incurred by the organizer or retailer.
Article R. 211-12
The provisions of articles R.211-3 to R.211-11 must be reproduced on brochures and travel contracts offered by the persons mentioned in article L.211-1.
Article R. 211-13
The buyer may no longer invoke the benefit of the clause provided for in 20° of article R.211-6 once the service has been provided.

Customer: natural or legal person who purchases a tourist package from Pyramide Des Sens By Enzo Elgouna. He/she is considered to be the beneficiary, personally or on behalf of the persons listed in the contract, of the tourist service purchased.
For all registrations concerning minors, the mention "the agreement of the holder(s) of parental authority" must be written on the registration form, specifying the identity of the said holder(s).
The present particular conditions of sale govern the offers of tourist packages proposed by Pyramide Des Sens By Enzo Elgouna. The customer acknowledges having read and accepted them on the day of registration. The present special conditions of sale are cumulative with the general conditions of sale and use of the www.pyramidedessensbyenzoelgouna.com website.
1 - Registration conditions
An order is a reservation submitted by the Customer and whose availability is confirmed by Pyramide Des Sens By Enzo Elgouna. Signing the travel contract (registration form) implies acceptance of the general and special conditions of sale and the information contained in the travel documents.
Tailor-made travel: this defines all the services provided by Pyramide Des Sens By Enzo Elgouna and relating to the implementation of the trip according to the Customer's expressed wishes.
The Customer is thus offered a personalized travel program following his request for a quote by telephone or via the website https://pyramidedessensbyenzoelgouna.com/, by clicking on : "or by email enzo.elgouna.eg@gmail.com.
A specialist consultant processes the request between 48 hours and 5 days, depending on the complexity of the tailor-made trip, and sends a quote containing a travel proposal. The request will be studied and proposed subject to availability, and will be adapted to the rates in force on the day of the quotation.
By registering for the trip, Pyramide Des Sens By Enzo Elgouna is able to set up the trip with its referenced local service providers.
The hotels and/or Villas included in the Pyramide Des Sens By Enzo Elgouna programs may be replaced by establishments of a similar or higher category, depending on local and/or seasonal constraints and/or booking deadlines. In this case, the hotels and/or villas specified in the quotation will be replaced by establishments of the same or higher category. Only a change of hotel and/or Villas in a category lower than the initial category may give rise to compensation for the customer. Pyramide Des Sens By Enzo Elgouna validates with the customer the final choice of accommodation, which will be confirmed and included in the travel log.
Pyramide Des Sens By Enzo Elgouna may suggest additional services depending on the destinations selected. Any reservation of a complementary service must be validated by the Customer by email or post. Pyramide Des Sens By Enzo Elgouna undertakes to satisfy the Customer by guaranteeing the same rates. However, as prices are subject to variation, the price of the complementary service may be higher or lower depending on the date of reservation by the Customer.
Tours and trips for small groups of 16 people maximum (one week) : Registration for group tours is made with Pyramide Des Sens By Enzo Elgouna sales consultants, by telephone on +33 (0)780 958 153 or via the website https://pyramidedessensbyenzoelgouna.com/ on the page of the trip concerned, by clicking on : "Reply". It is possible to add extensions to our tours.
Registration conditions are the same as for the tailor-made trip.
Our exclusive Pyramide Des Sens By Enzo Elgouna tours are guaranteed for a minimum of 6 or 8 people (depending on destinations and tours in Egypt).
If the number of people required for the tour is not reached, Pyramide Des Sens By Enzo Elgouna reserves the right to notify the customer by e-mail more than 30 days before departure:
- Or cancel the tour.
- Or offer the same tour on a different date.
- Or to propose an alternative destination in Egypt referenced Pyramide Des Sens By Enzo Elgouna.
In accordance with the regulations in force (article R211-10), if no solution proposed is suitable for the Customer, the latter may request a full refund of their trip.
Accepted quotation : Once the quotation has been drawn up (complete description of the trip), the customer validates his registration by sending by post or e-mail all the following elements: the quotation, the registration form and the general and special conditions of sale, signed and initialled.
Payment of the first deposit confirms registration.
On receipt of all documents, the sales contract is firm and final, and the quotation is deemed to have been accepted.
The quotation may be subject to change due to circumstances beyond the control of Pyramide Des Sens By Enzo Elgouna or its referenced local service providers (services not available at the time of booking, changes to air or transport schedules, local administrative constraints, site closures, climatic or natural conditions, force majeure, etc.). In such circumstances beyond its control, Pyramide Des Sens By Enzo Elgouna undertakes to do its utmost to find an alternative that respects the predefined tour.
The design of the trip requires an investment of time on the part of the consultants. In order to limit misuse, Pyramide Des Sens By Enzo Elgouna may charge €100 for each additional quote (this amount will be deducted from the first deposit of the validated sales contract).
2 - Payment of the travel package
Registration for a Pyramide Des Sens By Enzo Elgouna trip requires a deposit of 35% of the total cost of the trip.
It is expressly stated on the sales contract for certain destinations in Egypt that full payment for certain services, in particular air travel, is required upon registration for the trip. The cost of these services must be paid in addition to the initial deposit. Bookings will only be made on receipt of the deposit and subject to confirmation of availability at the time of booking.
The balance must be paid no later than 40 days before departure.
Payment can be made according to the Customer's choice:
- By credit card: using the secure Pyramide Des Sens By Enzo Elgouna online payment platform.
- By bank transfer: Pyramide Des Sens By Enzo Elgouna will send on simple request, the RIB on which to send the order of transfer, taking again in its wording, the number of file and the name of the Customer.
For travelers residing outside the Euro zone - deposit and balance transfers must be made in EURO. Transfer charges are payable by the payer (the client).
A pro-forma invoice is issued and sent to the customer as soon as the first deposit has been received.
For late registrations, less than 40 days before departure, payment must be made in full at the time of registration.
In accordance with article (L121-28-12°) of the French Consumer Code, the Travel Contract is not subject to the right of withdrawal for the purchase of travel services.
Any delay in the payment of the balance may be considered as a cancellation without the Customer being able to take advantage of this cancellation. The deposit paid will be considered as acquired by Terres Lointaines.
In exceptional cases, the Customer is invited to contact his consultant in order to avoid any risk of cancellation of the trip due to non-payment. Pyramide Des Sens By Enzo Elgouna undertakes to do everything in its power to find an amicable solution to any late payment which is the subject of a serious, sincere and justified reason.
A personalized travel diary containing all the documents required for the trip will be sent to the customer by e-mail before departure.
3 - Insurance
3.1 - Subscription of insurance referenced by Pyramide Des Sens By Enzo Elgouna
Pyramide Des Sens By Enzo Elgouna advisors provide information on the insurer's insurance offers during the quotation process. Chapka Assurances Voyages referenced by Pyramide Des Sens By Enzo Elgouna
Insurance premiums for the trip must be paid upon registration.
If one of the participants cancels for a valid reason, the other people registered on the same contract (indicated under "Number of participants in the trip") continue to benefit from Travel Insurance coverage.
In the event of cancellation by the customer, insurance premiums will not be reimbursed.
In the event of a claim, customers who have taken out one of these insurances must personally contact the insurance emergency number so that the insurance can be activated.
3.2 - Non-subscription of insurance referenced by Pyramide Des Sens By Enzo Elgouna.
In all cases, customers must ensure that they are covered by a comprehensive insurance policy known as Travel Insurance. This must be taken out at the time of registration.
The Customer undertakes to bring with him his travel insurance contract and his repatriation assistance number. In no case Pyramide Des Sens By Enzo Elgouna can replace the absence of subscription of the Customer to a multi-risk Travel Insurance.
3.3 - Lost or damaged baggage
In the event of lost or damaged baggage during air transport, the customer must immediately and in all cases file a report with the airline concerned, or with the airport baggage department, usually in the customs hall near the baggage delivery area. The customer then obtains a PIR (Property Irregularity Report) number, a unique code that can be used to track delayed or damaged baggage. In the event of lost baggage and after a period of 21 days, the declared values will give rise to compensation. This procedure is automatically triggered once the PIR procedure has been followed.
4 - Modification or cancellation by the Customer
The travel contract sets out the destination and dates of the trip to Egypt. Any request for modification of these elements at the Customer's initiative will incur 100% of the modification or cancellation fees. Pyramide Des Sens By Enzo Elgouna reserves the right to refuse any request for cancellation or modification, subject to availability and current rates.
Any other modification (itinerary, airline, accommodation, activity) at the customer's request after payment of the deposit and confirmed reservations, will incur a modification fee of €50 per file (in addition to the price difference).
In the event of cancellation, the Customer must immediately advise Pyramide Des Sens By Enzo Elgouna of his decision of cancellation by registered letter with AR, La poste-en-ligne. It is the date of sending of the registered letter with AR which will be retained by Pyramide Des Sens By Enzo Elgouna like date of cancellation for the invoicing of the expenses of cancellation. The calculation of cancellation fees is defined in § 4.1 and 4.2.
In the event of cancellation by the customer, for any reason whatsoever, no reimbursement will be made for any costs incurred by the customer other than those covered by the package, such as visa fees (including Chronopost postage), vaccination costs, or non-cancellable pre-scheduled SNCF or transport tickets.
Failure to check in at the place of departure, whatever the cause, even in cases of force majeure, as well as the impossibility of taking departure due to the non-presentation of travel documents (passport, visa, vaccination certificate, etc.) are considered as late cancellations giving rise to 100% cancellation charges.
Any trip interrupted or shortened by one or more of the participants registered in the sales contract, for any reason whatsoever, will not give rise to any reimbursement.
4.1 Cancellation of tickets issued
Due to the early issuance of airline tickets imposed by airlines, upon ticket issuance and regardless of the cancellation date, Pyramide Des Sens By Enzo Elgouna applies a cancellation fee equal to 100% of the ticket price. Any request to change the name or part of the spelling of the name after the ticket has been issued is considered a cancellation by the Customer. At the customer's request, a new ticket can be issued at the current price. Where applicable, taxes may be refunded on request.
4.2 Cancellation policy for ground services.
In the event of cancellation by the customer, the following compensation will be deducted from the total cost of the land services:
- Cancellation more than 60 days before departure: 20% with a minimum of €300 per person
- Cancellation between 60 and 46 days before departure: 30% with a minimum of €400 per person
- Cancellation between 45 and 21 days before departure: 50% of the fee
- Cancellation between 20 and 15 days before departure: 75% of the amount due
- Cancellation less than 15 days before departure: 100% of the amount.
Certain services such as cruises, hotels and/or Villas and exceptional products, in particular because of advantageous pricing for the Customer, or important events requiring early booking (high tourist season, congresses, sporting or political or cultural events, etc.) or for other specific reasons, may lead to changes in the scale of cancellation fees. In such cases, the applicable cancellation charges will be indicated on the registration form.
The customer is contractually obliged to pay the balance of the cancellation fees applied and defined in § 4.1 and 4.2 when the deposit received at registration is less than the sum of the fees withheld.
4.3 Cancellation by one of the trip participants
If one or more travellers registered on the same file (registration form) cancel their participation in a trip maintained for the other participants, the cancellation fee schedule below will be calculated for the traveller who cancels and cumulatively on :
- The price of personal services (air tickets, ground services, etc.)
- The share of the trip's shared services that will be consumed and shared by the other travellers.
The calculation of cancellation fees is defined in § 4.1 and 4.2.
If one or more travellers registered on the same booking cancel(s), the trip may be maintained as long as the participants have paid, prior to departure, any additional costs for services that have had to be modified due to the cancellation of the traveller(s).
If several customers have registered for the same booking and one of them cancels, the cancellation fee will be deducted from the total amount of the deposits, regardless of who made the payment.
5 - Modification or cancellation by Pyramide Des Sens By Enzo Elgouna
5.1 General case
If Pyramide Des Sens By Enzo Elgouna is exceptionally forced to cancel the departure of a trip, the customer will be informed at the latest within the following deadlines:
- 30 days before the start of the trip to Egypt for trips, tours or cruises lasting more than six days.
Pyramide Des Sens By Enzo Elgouna will always endeavour to propose an alternative, but if this one did not suit you, Pyramide Des Sens By Enzo Elgouna will refund you entirely the payments carried out, but is not held with an additional compensation.
5.2 Modification due to the organizer
Before the beginning of the trip, Pyramide Des Sens By Enzo Elgouna can unilaterally modify the clauses of the contract other than the price in accordance with article L.211-12, provided that the modification is minor (e.g. replacement of a hotel of equivalent category within the framework of a circuit, or of a boat for a cruise). Pyramide Des Sens By Enzo Elgouna will inform the traveler in writing on a durable medium.
As far as air travel is concerned, Pyramide Des Sens By Enzo Elgouna undertakes to inform the customer of the times and types of transport mentioned at the time of booking. These elements remain indicative and are subject to revision or adaptation according to the contingencies imposed by the airlines.
Schedules and means of transport will be communicated when the travel diary is sent by e-mail. In the accepted quote, Pyramide Des Sens By Enzo Elgouna reserves the right to change airlines in order to respect the proper execution of the initial program.
5.3 Modification or cancellation prior to departure
When, prior to departure, compliance with one of the essential elements of the contract within the meaning of article L.211-16-V et -VI of the French Tourism Code is rendered impossible as a result of an external event imposed on Pyramide Des Sens By Enzo Elgouna, we will notify the customer as soon as possible, and the latter will have the option of accepting the proposed modification, or cancelling the contract without charge.
The customer will not be entitled to any compensation if the cancellation of the trip is imposed by circumstances of force majeure or for reasons relating to the safety of travelers.
5.4 Modification or cancellation after departure
If, after departure, an essential component of the trip cannot be carried out within the meaning of art. L.211-16-V et -VI, Pyramide Des Sens By Enzo Elgouna will offer, at no extra charge, an appropriate alternative service, if possible of equal or higher quality. When the proposed services result in a trip of inferior quality, the organizer will offer the traveler a price reduction. The traveler may only refuse the other services offered if they are not comparable to what was provided for in the contract, or if the price reduction granted is not appropriate.
6 - Prices
6.1.1 The prices that may appear on the Pyramide Des Sens By Enzo Elgouna website are indicative prices, said "from", and do not have contract value. Final prices will be confirmed on the contract upon registration.
6.1.2 The prices communicated at the time of registration have been calculated on the basis of data known at the date of publication of the contract. They may be adjusted in the event of variation in any of the following elements:
- modification of services not available at the time of booking
- the cost of transport resulting from the cost of fuel,
- the level of taxes or fees on travel services included in the contract, imposed by a third party not directly involved in the execution of the contract, including tourist taxes, landing taxes or embarkation and disembarkation taxes at ports and airports,
- exchange rates relevant to the contract.
6.2 In case of modification of these conditions, Pyramide Des Sens By Enzo Elgouna reserves the right to modify the selling price with a notice of at least 30 days from the departure date. A supporting statement will be given to the customer on a durable medium, and if the increase exceeds 5%, the customer will have the option of cancelling without charge.
If applicable, any refusal of the increase by the customer will be considered as a cancellation and will incur the contractual cancellation charges with application of the scale in § 4.1 and 4.2.
6.3 The price does not include the cost of passports, visas, vaccination certificates, exceptional expenses resulting from fortuitous events (strikes, weather conditions), insurance, excess baggage, personal expenses (drinks, parking fees, tolls, telephone charges, tips, etc.), and in general any services not listed on the contract.
6.4 All individual bookings will be subject to a single room supplement.
6.5 When booking a triple room, please note that it is generally a room equipped with a double bed, plus an extra bed which may be less comfortable, especially for an adult.
6.6 Our prices are based on a number of nights (not days). The customer may be deprived of a few hours' stay on arrival and departure, either because of flight schedules, or because of international hotel practices regarding the availability of rooms and villas, without being entitled to any compensation.
7 - Air transport
Airline tickets issued by Pyramide Des Sens By Enzo Elgouna are only valid within the framework of a tourist package - No request for ticket reimbursement can be made directly to the airlines.
The names of the airlines indicated in the travel documents are subject to change. Pyramide Des Sens By Enzo Elgouna undertakes to ensure that all airlines used for flights departing from France are authorized by the competent administrative authorities to serve the French territory.
Pyramide Des Sens By Enzo Elgouna cannot be held responsible for any costs related to early or late departure or arrival times, nor can they justify a cancellation by the customer.
Airlines may mandate another company to carry out the flight (code-share). Pyramide Des Sens By Enzo Elgouna cannot be held responsible for any disorganization on this point (the Customer must, if necessary, address his duly justified complaint directly to the airline company which sold the flight).
The liability of the airlines participating in the trips presented in the contract, as well as that of their representatives, agents or employees, is limited, in the event of damage, complaints or claims of any kind, to the air transport of passengers and their baggage exclusively, as specified in their conditions of carriage. The ticket shall constitute the sole contract between the latter and the customer. The customer is responsible for his or her ticket, and we decline all responsibility should he or she lose it. Pyramide Des Sens By Enzo Elgouna cannot be held responsible in place of the carriers providing passenger transport.
In accordance with the Montreal Convention, any airline may be required to modify, without prior notice, the timetable and/or itinerary, as well as the departure and destination airports. Changes made by the airline company, in particular as a result of technical, climatic or political incidents, delays, strikes, additional stopovers, changes to aircraft or routes, or cancellations outside Pyramide Des Sens By Enzo Elgouna's control, do not justify cancellation of the trip by the Customer. Terres Lointaines will not pay any compensation for such changes imposed by the airlines.
Therefore, Pyramide Des Sens By Enzo Elgouna will not be liable to compensate the Customer for any ground services not provided or expenses incurred due to delays or modifications for which the airlines are responsible.
If the Customer decides to cancel the trip, he/she will be charged the cancellation fees referred to in § 4.1 and 4.2. Pyramide Des Sens By Enzo Elgouna will not reimburse expenses (cabs, hotels, Villas, transportation, catering, etc.), as long as the Customer is under the protection of the airline.
In the event of a delay in transportation to or from the destination and/or damage to or loss of baggage, denied boarding (overbooking) and/or flight cancellation by the airline, we recommend that the traveler retain all original documents (tickets, boarding passes, baggage vouchers, etc.) to enable him/her to assert his/her rights against the airline, and to request any written proof from the airline in the event of denied boarding (overbooking) or flight cancellation. In view of the short deadlines imposed, the customer will send the airline his claim with a copy of the supporting documents as soon as possible, and will retain the originals.
Pyramide Des Sens By Enzo Elgouna remains at the disposal of the Customer via its Customer Service in order to accompany him in his steps.
If the customer organizes his own pre- and post-trip services to the place where the trip begins and to his home when he returns from the trip, Pyramide Des Sens By Enzo Elgouna recommends that he purchase services (transport tickets, etc.) that can be modified and/or reimbursed, and that he allow reasonable transfer times between airports/stations. In the event of a case of force majeure, an unforeseeable and insurmountable act of a third party or the act of a Customer which would modify the services of the trip subscribed to Terres Lointaines and would imply modifications of the services, Terres Lointaines will not reimburse the expenses incurred.
8 - Terrestrial services
Services voluntarily modified by the Customer on site are subject to the conditions of the local service providers: additional or replacement services generating an additional cost must be paid directly to the local travel agencies and cannot in any case engage the responsibility of Pyramide Des Sens By Enzo Elgouna. If the Customer decides on the spot not to use certain services envisaged, those (transfers, excursions, lodgings...) will not give place to any refunding on behalf of Pyramide Des Sens By Enzo Elgouna.
9 - Liability
9.1 Responsibility of the organizer
9.1.1 Pyramide Des Sens By Enzo Elgouna is responsible for the proper execution of the travel services provided for in the contract in accordance with Article L.211-16 of the Tourism Code and is required to provide assistance to the traveler if he is in difficulty, in accordance with Article L.211-17-1 of the French Tourism Code.
9.1.2 In accordance with article L.211-16 II of the French Tourism Code, when the customer finds that a service does not correspond to the contract, and in order not to suffer the consequences for the rest of your trip, the customer must communicate any non-conformity as a matter of urgency to our local referent. In the event of a complaint on return from the trip, the failure to report will be taken into account. This may have an influence on the possible amount of refunds if this could have avoided or reduced the damage.
9.1.3 However, in accordance with article L.211-16, Pyramide Des Sens By Enzo Elgouna's liability is limited if the damage is attributable to the traveler, or to exceptional and unavoidable circumstances. It is also limited if it is attributable to a third party unrelated to the provision of travel services included in the contract, and if it is unforeseeable or unavoidable.
9.2 Limitation of liability
Pyramide Des Sens By Enzo Elgouna cannot be held responsible for the consequences of the following events:
- Online check-in and boarding pass
It is the customer's responsibility to consult the website of the airline operating the flight(s) and to complete the compulsory pre-check-in and check-in procedures. The individual customer checks in with the airline concerned and obtains a boarding pass. - Failure to register
Pyramide Des Sens By Enzo Elgouna can in no way replace the individual responsibility of the customer, who is responsible for ensuring that all formalities are completed before departure (passport, visas, vaccinations, etc.), including for children. They must be checked by each participant before departure with the relevant organizations (consulate, customs, etc.). Failure to comply with these regulations, or any defect or irregularity in these documents, is the sole responsibility of the participant, who will be liable for any costs incurred (e.g.: an inconsistency between the name on the passport or identity card and that on the plane ticket due to incorrect wording at registration may result either in cancellation of the flight without recourse, or in a new ticket being issued at the customer's expense).
Delay(s) caused by the above-mentioned events, and any resulting changes to the itinerary, may not give rise to any compensation whatsoever, particularly in the event of a change to the duration of the program initially planned, or a delay at a connecting flight.
Any additional costs incurred as a result of a disruption (tax, hotel, Villas, parking, etc.) will remain at the customer's expense. These changes may occur before or during the trip, at the initiative of Pyramide Des Sens By Enzo Elgouna directly, or its guides, or its local service providers.
In the event of the customer failing to check in at the place of departure of the air trip, 100% of the cost of the trip will be retained. - Loss of tickets
The customer is responsible for his ticket (plane or boat ticket), and Pyramide Des Sens By Enzo Elgouna declines all responsibility if he should lose it. - Unforeseeable or unavoidable events
War, political unrest, demonstrations, riots, strikes, technical incidents, airspace or airport paralysis, loss, theft or delay of baggage, bad weather, natural disasters. - Exceptional circumstances
In the event of cancellation or modification of the trip imposed by exceptional, unforeseeable or unavoidable circumstances, or for reasons of traveler safety, or imposed by an administrative authority such as the Ministry of Foreign Affairs. No compensation will be due to the customer by Pyramide Des Sens By Enzo Elgouna in the event that we would have to cancel or modify the trip initially planned.
Each participant must comply with the advice and instructions given by the manager representing Pyramide Des Sens By Enzo Elgouna.
Pyramide Des Sens By Enzo Elgouna can not be held responsible for all optional activities booked directly on site and not paid to Pyramide Des Sens By Enzo Elgouna. Pyramide Des Sens By Enzo Elgouna cannot be held responsible for any accidents occurring during the practice of activities not defined in the programs.
Pyramide Des Sens By Enzo Elgouna will do its utmost to satisfy specific requests concerning meals (vegetarian, food allergies...), accommodation and transport but cannot guarantee total adaptation of requests.
Pyramide Des Sens By Enzo Elgouna cannot be held responsible for incidents relating to non-compliance with instructions, particularly with regard to the risk of theft of personal effects and luggage.
9.3 Unusual services not listed
Terres Lointaines may, at the express request of a customer, sell services not listed in our production. These services may not meet our usual selection criteria. Acceptance of the program will not give rise to any subsequent compensation, as the customer has been informed that the said product has not been selected by us.
10 - Minors
Registration requests for minors must be signed by the father, mother or legal guardian and marked "Agreement of father, mother or guardian". In addition to the identity documents required for travel, they must also be in possession of an authorization to leave mainland France. Lastly, a telephone number and address must be provided to enable the child or guardian to make direct contact.
For minors traveling with one of their parents, guardians or other adults, the Customer must ensure that he/she is in possession of the necessary documents for the accompanying minor (national identity card or passport and, where applicable, authorization to leave the country) to allow him/her to leave the country.
11 - Personal information and RGPD
Customers have the right to access, modify, rectify and delete data concerning them (article 34 of the French Data Protection Act). The very nature of our business of organizing trips abroad implies that your data may be communicated to our local partners within or outside the European Union. To ensure the proper management of our business, this data will only be used during the actual travel period. Our partners are bound by professional ethics to respect the confidentiality of your data. To exercise his rights or if the Customer does not wish his data to be transmitted, he must send his request in writing to Pyramide Des Sens By Enzo Elgouna, with a request for acknowledgement of reading and receipt by e-mail: enzo.elgouna.eg@gmail.com.
12 - Complaints
Any complaint concerning the non-performance or improper performance of the travel contract must be immediately reported to the guides or local receptives, so that they can take all measures and provide the means to resolve the situation. Complaints about the progress of the trip must be sent in writing within 15 days to Pyramide Des Sens By Enzo Elgouna, with a request for acknowledgement of receipt by e-mail: enzo.elgouna.eg@gmail.com. accompanied by supporting documents. Pyramide Des Sens By Enzo Elgouna advises the Customer to inform his consultant as soon as possible and to address any complaint.
If the Customer Service Department has not received a satisfactory reply within 60 days, the Customer may refer the matter to the Tourism and Travel Ombudsman, whose contact details and procedures are available on his website www.mtv.travel.
13 - Applicable Law and Jurisdiction
The contract is subject in all respects to French law, failing amicable resolution as defined in Article 12, any dispute that may arise from the conclusion, interpretation, performance and / or termination of the contract will be subject to the exclusive jurisdiction of the courts of the location of the registered office of Pyramide Des Sens By Enzo Elgouna.
14 - Formalities
Visas : Depending on the destination, a visa may be required. Pyramide Des Sens By Enzo Elgouna does not take charge of their creation, it is up to the Customer to carry out this last at his expenses. To find out the precise conditions for each country, the Customer may ask his specialist advisor for advice.
The information provided is valid only for French nationals. For all other nationalities, it is essential for the Customer to contact the competent authorities of the country concerned. Pyramide Des Sens By Enzo Elgouna cannot be held responsible for the consequences of any failure on the part of the Customer to allow access to the chosen country.
Health and Safety Risks: The Customer must ensure that he/she is able to make the trip with regard to the program and destination in Egypt (health, mobility, handicap...). In case of doubt, Pyramide Des Sens By Enzo Elgouna advises the Customer to seek medical advice before any commitment.
